Company Number 10615713 (the “Company” or “We/us”) is committed to respecting and protecting the privacy of all visitors of any of our Websites (https://petioleapp.com/, http://petiolex.com, https://agfluencers.com) as well as all users of our Petiole Leaf Area, PetioleX or Petiole Pro (“App”) available via online stores. This Privacy Policy explains our practices regarding the use of personal data collected and processed through our Website, our App or otherwise provided to us by email or via other sites that link to us.

This Privacy Policy is incorporated into, and part of the App Terms and Conditions available on the App and the App Store.

1. User consent

By accessing to or using our Website and/or App, and in particular by providing your personal information upon registration through the App, using the App, or contacting us for any reason, you explicitly accept this Privacy Policy and You provide us with full consent to the collection, storage and processing of personal data for which you are responsible in accordance with the terms set out in this policy, including the sending of electronic commercial communications.

If you do not wish to receive commercial communications (defined below), you can expressly opt out by sending a notification to support@petioleapp.com or by clicking the unsubscribe link in our email communications.

2. Data collection

Sending us an Email. Upon sending us an email, we will collect the following personal data: email address and name and surname. This data is obligatory and if they are not provided we will not get back to you. This data is used for processing your request and contacting you for further communication.
Registration. On registering for App, we will collect your name, email address, geolocation. This data is obligatory and if they are not provided, an account cannot be created. You may disable the App’s read-only use of your geolocation and/or system clock and/or access to your camera via the settings on your phone however this might restrict your access to all the functionalities of the App.
Use of our App. On using our App, we may collect a variety of information about yourself to us, such as your name, email address, postal mailing address, telephone number, credit card number, and billing information when you register for paid features of Petiole Services or otherwise use the features and functionality of the App. Our App may request permissions to use data from a camera sensor. This data is handled as personal and sensitive information and our App will use only data received in a course of leaf area measurement such as photo of a leaf and information about leaf surface area. We will never scan or import your photo library or camera roll.
Prohibited data. In all events, it is forbidden to submit to us or upload to the App or the Website any data that contains sensitive data that is relative to identifiable persons such as: your and or third party’s racial origin, membership in a trade union, religion, ideology and sexual life, your and or third party’s health, unless it proves necessary in order to assert any handicap or disability situation for labour purposes; or your and or third party’s relative to the commission of criminal offenses or proceedings and associated penalties or fines

3. Data Use

General. Personal Data is solely used for the provision and management of your Petiole account and the Services provided to you through our App (as described in the Petiole App Terms and Conditions), to measure and improve those Services and features, to provide you with customer support, to develop our contacts with you, the sending of any newsletters, notification emails or commercial communications in general about the Services and products and any new features, offers or promotions offered by us, and for compliance with the Terms and other legal communications. Registered users are also sent notification emails, or push-up notification on your phone (which can be disabled through the settings on your phone) about activities on the App.
Statistical analysis. We may process your information and data regarding your use of the App on an aggregated non-identifiable basis for establishing user general attributes and profiles and share such information with third parties e.g. to help improve or promote our Service or offer joint services.

Recommendations. We may incorporate automated recommendation features, in order to provide targeted recommendations to you in accordance with your use of the App.
Data removal. You can request the deletion of information about yourself from our system by emailing support@petioleapp.com.

Commercial Communications. By filling in and sending your data to us, you expressly consent to receive electronic commercial communications regarding the subject matter of the Website, App and other Services in accordance to applicable law, including alerts, notices, newsletters, offers and promotions. If you do not wish to receive information mentioned above you can expressly opt out by sending a notification to support@petioleapp.com.

4. Disclosure

We treat your personal data with strict confidentiality in accordance with applicable law. However we shall disclose any information about you or your use of our Website and/or App, in compliance with a legal obligation or in order to correctly deliver our Services or perform other obligations in accordance to the applicable regulations and rules set forth in the Petiole App Terms and Conditions, or in the event of a sale of change of control of the Company.

5. Petiole as Data Controller

We are data controller of your basic account information and we shall process this information for providing our Services to you and other users in accordance with this policy.

6. Petiole as Data Processor

You have control over your Petiole account, and we only process the data you submit on your behalf, according to your instructions, and in accordance with applicable privacy laws (as “Data Processor”).
To the extent that we are such Data Processor, we shall

  • implement appropriate technical and organisational measures to safeguard the data against any unauthorised or unlawful access, loss, destruction, theft, use or disclosure in accordance with applicable law.
  • limit access to the data only to those employees who need to know it to enable the Processor to perform the Services;
  • only process the personal data as specified by this Privacy Policy and in accordance with your instructions, and will not use the data for any purposes other than those related to the performance of the Services or pursuant to your written instructions.

Upon the expiry or termination of this Agreement by way of de-registration, or upon your request, we will cease any and all use of the data and will destroy or return it to you except as provided above with respect to backed-up data and termination. We will not disclose the data to any third party without your prior written consent.

As Data Processor we may provide access to any such data to a subcontractor processor if we reasonably consider such access and processing necessary to the performance of the Services. In the event of such access and before the access takes place, we shall ensure that an agreement with the third party is in place which is sufficient to require it to treat personal data in accordance with the applicable provisions of this Agreement and applicable, signing for an on your behalf. In particular, you authorise us to subcontract hosting services to a preselected provider. Further third party subcontractor processors will be notified to you prior to subcontracting.
Warranties. You agree to indemnify and keep us harmless from all claims, damages and losses we may suffer relating to or arising out of the processing of any data submitted to our systems during the course of use of the App and the provision of the Services.

7. Data Security

We have adopted technical and organisational measures to preserve and protect your personal information from unauthorised use or access and from being altered, lost or misused, taking into account the technological state of art, the features of the information stored and the risks to which information is exposed.
However, due to the nature of the information and related technology, we cannot ensure or guarantee the security of your personal information and expressly disclaims any such obligation. If we learn of a security breach, then we will attempt to notify You electronically so that You can take appropriate steps.

8. User Rights

You have the right to access, rectify, block and oppose any processing of your personal data that we may have. Moreover, you may at any time withdraw your consent to the processing of your personal data and information. This withdrawal will not have retroactive effects but may prevent providing the Services. The above is without prejudice to provisions of applicable law enabling conservation of data for the purpose of defending our responsibility and complying with mandatory legal obligations. We will assist you in accordance with the functionalities of the App and the Term of this agreement to attend any user request with regard to the processing of their personal data.

9. Consent

By completing the App hereby submitting us your personal data, you declare to have read and accepted the terms of this Privacy Policy. Without prejudice to the generality of the foregoing, you expressly and unequivocally consent to:

  • the collection and processing of your personal data by us in accordance with the indicated purposes and this Privacy Policy; and
  • the processing of your data outside the European Economic Area by indicated third party data processor subcontractors (e.g. for the purpose of providing professional Services to us such as hosting or database management Services);

Your consent to personal data collection and processing may be revoked, without retroactive effects, in accordance to applicable law.

10. General

We reserve the right to amend the terms of this Privacy Policy and will notify you by providing a clear notice of these changes by email, and in this Privacy Policy. If you continue to use and/or access our App after such update, you will be deemed to accept the new terms. If you do not accept the update, please notify us and we will terminate your account and remove any of your personal data (except as required to be maintained for legal purposes), and you will not be able to continue to use our Services.

Unless a specific local regulation of mandatory application provides otherwise, the Privacy Policy is governed by the laws of the England and Wales.
